5. The prohibitions referred to in section 16 of the Act respecting threatened or vulnerable species (chapter E-12.01) do not apply to the maidenhair fern, Canadian wild ginger, crinkleroot, large toothwort, Canada lily, ostrich fern, bloodroot, white trillium or large-flowered bellwort, except as regards the annual harvesting from a wild population of more than 5 whole specimens or underground parts of any of those species or the trading in any whole specimen or any underground part harvested from a wild population.
The prohibitions also do not apply if the specimens of a wild population of the species are situated in a habitat that is to be irremediably altered as a result of the carrying out of a project authorized under the Environment Quality Act (chapter Q-2).
